Wardship

These are highly complex High Court proceedings involving children. They often involve difficult decisions about medical treatment or protecting children from severe risk of harm. One recent high profile case was the Charlie Gard case, where Great Ormond Street Hospital applied to the High Court for permission to withdraw treatment from a child with a rare genetic disorder and Charlie’s parents disagreed with the clinicians and wanted to be able to take Charlie to the USA for treatment. The case went from the High Court to the Supreme Court and after that to the European Court of Human Rights and back to the High Court before Charlie’s life support machine was switched off and he sadly died. This illustrates the complexity and the tragedy that too often surrounds these kind of cases.

What should I do if I am involved in a dispute over medical treatment for a child or I am threatened with wardship proceedings or proceedings under the Inherent Jurisdiction?

You should immediately seek legal advice. These proceedings are too complicated and the potential outcomes too significant either to waste any time or to attempt to deal with them yourself.
